Divorce ProcedureCan I get a Divorce without a Solicitor?There is a very quick and easy way of getting divorced but it only applies in certain circumstances. If there are no financial claims and are no children under the age of 16 years, you can raise an action by using our DIY Divorce. This can only be done if the basis of the divorce is one-year separation with consent or two years without consent. It does not apply to adultery or unreasonable behaviour cases.
What if there are children under 16 or, if I want to use Adultery or Unreasonable Behaviour as Grounds for Divorce?Ordinary Procedure - Undefended Divorce ActionsIf you have reached agreement on assets and liabilities and there are children under 16 years, or if the divorce is based on unreasonable behaviour or adultery you must raise proceedings by way of the ordinary procedure which will require you to satisfy the court that you are entitled to a divorce. The care arrangements for your children will have to be outlined in detail, even though there may not be any dispute. If there is no dispute then this procedure can be fairly quick (two to three months typically) but it does involve more legal work and is therefore more expensive. Please Note: Once you are divorced you cannot thereafter seek a financial claim or pension share.
