If no other methods of reaching agreement are left open to you then the only option to try and achieve a resolution is by going to court.
This is a route should be avoided if at all possible. Courts unfortunately have the reputation of being expensive, slow, time consuming and a destroyer of any semblance of co-operation that the parties may still have.
The main difference about going to court however is that you are surrendering the decision making to someone else – the Sheriff. With the other options available you are at least involved in the decision making process throughout and you know what you are agreeing to. If you go to court, the Sheriff will make a decision for you and it may not be a decision you like.
Because the courts have so much discretion particularly in financial matters, there is no knowing what the court will do. Even the most experienced solicitor cannot guarantee what a Sheriff’s decision will be.
